How Federalism Has Changed Since the Ratificationt of the Constitution Essay

Federalism has evolved over the course of American history. At different points in time, the balance and boundaries between the national and state government have changed substantially. In the twentieth century, the role of the national government expanded dramatically, and it continues to expand in the twenty-first century. Dual Federalism (1789–1945) Dual federalism describes the nature of federalism for the first 150 years of the American republic, roughly 1789 through World War II. The Constitution outlined provisions for two types of government in the United States, national and state. For the most part, the national government dealt with national defense, foreign policy, and fostering commerce, whereas the states dealt with local matters, economic regulation, and criminal law. This type of federalism is also calledlayer-cake federalism because, like a layer cake, the states’ and the national governments each had their own distinct areas of responsibility, and the different levels rarely overlapped. The Civil War and the Fourteenth Amendment (1861–1868) Part of the disputes that led to the Civil War (1861–1865) concerned federalism. Many Southerners felt that state governments alone had the right to make important decisions, such as whether slavery should be legal. Advocates ofstates’ rights believed that the individual state governments had power over the federal government because the states had ratified the Constitution to create the federal government in the first place. Most Southern states eventually seceded from the Union because they felt that secession was the only way to protect their rights. But Abraham Lincoln and many Northerners held that the Union could not be dissolved. The Union victory solidified the federal government’s power over the states and ended the debate over states’ rights. The Fourteenth Amendment, ratified a few years after the Civil War in 1868, includes three key clauses, which limit state power and protect the basic rights of citizens: 1.The privileges and immunities claus e declares that no state can deny any citizen the privileges and immunities of American citizenship. 2.The due process clause limits states’ abilities to deprive citizens of their legal rights. 3.The equal protection clause declares that all people get the equal protection of the laws Industrialization and Globalization (1865–1945) The nature of government and politics in the United States changed dramatically in the late nineteenth and early twentieth centuries. The national government assumed a larger role as a result of two major events: 1.Industrialization: The economy became a national, industrial economy, and the federal government was much better equipped than the states to deal with this change. For much of the nineteenth century, the government pursued a hands-off, laissez-faire economic policy, but it began to take a stronger regulatory role in the early twentieth century. 2.Globalization: Because of its vast economy and its extensive trading networks, the United States emerged as a global economic power. The federal government assumed a greater economic role as American businesses and states began trading abroad heavily. Although these events played out over many decades, they reached their high points during the presidency of Franklin Roosevelt (1933–1945). The Great Depression, brought about by the crash of the stock market in 1929, was one of the most severe economic downturns in American history. Many businesses failed, roughly one-third of the population was out of work, and poverty was widespread. In response, Roosevelt implemented the New Deal, a series of programs and policies that attempted to revive the economy and prevent further depression. The New Deal included increased regulation of banking and commerce and programs to alleviate poverty, including the formation of the Works Progress Administration and a social security plan. In order to implement these programs, the national government had to grow dramatically, which consequently took power away from the states. Cooperative Federalism (1945–1969) Federalism over much of the last century has more closely resembled a marble cake rather than a layer cake as federal authority and state authority have become intertwined. The national government has become integrated with the state and local governments, making it difficult to tell where one type of government begins and the other types end. State and local governments administer many federal programs, for example, and states depend heavily on federal funds to support their own programs. This type of federalism is calledcooperative federalism, or marble-cake federalism. New Federalism (1969–present) Since the 1970s, political leaders and scholars of the New Federalism school have argued that the national government has grown too powerful and that power should be given back to the states. Although the national government remains extremely important, state governments have regained some power. Richard Nixon began supporting New Federalism during his presidency (1969–1974), and every president since Nixon has continued to support the return of some powers to state and local governments. Although political leaders disagree on the details, most support the general principle of giving power to the states. New Federalism has taken concrete form in a variety of policies. New Federalists have argued for specific limits on federal power, as well as devolution, a policy of giving states power and responsibility for some programs. For example, the 1996 welfare reforms gave states the ability to spend federal dollars as they saw fit. Supporters claim that local and state governments c an be more effective because they understand the circumstances of the issue in their state. They argue that a one-size-fits-all program imposed by Washington cannot function as effectively. Advantages and Disadvantages of New Federalism New Federalism appeals to many people because of its emphasis on local and state governments. Many Americans feel that the national government has become too intrusive and unaccountable. These people champion state and local government as closer to the people and thus more accountable. However, Americans often want a single seat of power for some tasks. Competing local and state governments can cause more problems than they solve, especially during emergencies. For example, the terrible hurricanes of 2005 led residents of Louisiana, Mississippi, and Alabama to demand a better, more unified national response. The Supreme Court and New Federalism The Supreme Court has played a New Federalist role by siding with state governments in a number of cases. Perhaps the most well-known of these cases is United States v. Lopez (1995), in which the Court ruled that Congress had overstepped its authority in creating gun-free school zones. More controversially, in 2000, the Court struck down parts of the Violence Against Women Act (1994) for much the same reason in United States v. Morrison. In other cases, the court has ruled that state governments cannot be sued for violating rights established by federal law. Overall, the Supreme Court in the 1990s reduced the power of the federal government in important ways, particularly in relation to the commerce clause.

He no longer agreed with the ideals of the advertising world. In Chiat’s essay, â€Å"Illusions are Forever,† he uncovers the true ideals of the marketing industry. His essay discusses how the lies in advertising â€Å"lie in the situations, values, beliefs, and cultural norms used to sell a message.†(212) Through this essay, Chiat uses strong, vivacious words to create an image of the true face of advertising. In the same manner, he includes examples and descriptions that embellish that image and grab the attention of the reader. Amidst all of this, Chiat composes his essay in a manner that allows for a clear, insightful message to come across. Chiat is indeed bitter of advertising, but that does not affect his message. He remains conversational throughout the course of the essay. The technique that Chiat uses throughout his writing is superb, and he does an excellent job of getting his message across. Chiat uses strong, vivid word choice throughout his essay to give his readers a precise image of the schemes used by today’s advertisers. Chiat’s words â€Å"unrelenting†(213) and â€Å"24-hour-a-day drumbeat†(213) allow his readers to imagine how advertisers are constantly hammering their ideas into the heads of the viewers. Words such as â€Å"robs us†(213) allow Chiat to make the point that advertisers rob Americans of their view of life, replacing it instead with an â€Å"illusion†. Chiat also uses â€Å"seductive†(214) to give his readers a further understanding of what advertisers are seeking. Chiat is using words such as â€Å"seductive†(214) to enlighten consumers to the idea that advertisers twist their lies in a fashion that is seemingly pleasing to the eyes but is still made up of lies. Chiat’s words are critical of advertisers and how they do not truly care about their consumer. Chiat, nonetheless, does not blind his reader to the essay’s purpose by getting lost in the emotional rhetoric. Chiat’s writing is filled with informative and detailed rhetorical modes that greatly add to the impact of his argument. Unlike many writers who seem to get lost in their descriptions of a topic, Chiat includes examples, definitions and descriptions while still shining light upon the advertising backdrop. One instance of this occurs when Chiat uses the example of the wedding ring from DeBaers, Chiat uses this example to help the readers visualize how the advertisers seek to infiltrate the minds of their consumers. Following this example, Chiat then defines â€Å"unmediated†(213) as â€Å"without media†(213). Chiat defines â€Å"unmediated†(213), a word that most take lightly, in an effort to give his readers a clear understanding of the strategies used by advertisers. A few paragraphs later, Chiat proceeds to describe internet advertising. Chiat gives a clear image to his readers on how internet advertisers drag adults in with their â€Å"authoritative-looking†(213) websites. Chiat’s placement of these examples, definitions and descriptions is excellent. He places them in positions that not only increase the flow of the writing but also pique the interests of his readers. Adding the rhetorical modes previously mentioned is very important for writers such as Chiat because there are points in writing where the pace of the writing dies down. Chiat places these modes in marvelous positions that keep up the pace of the article as it moves along. Along with descriptive words and examples, organization of ideas is also critical when writing an essay, and Chiat’s layout of paragraphs is very logical, and in turn deductive, in other words, the reasoning follows the thesis. Chiat opens up his essay with a bit of background on advertising in order to strengthen the thesis that follows. His thesis is clear and to the point. Because his thesis is mentioned in the beginning of the essay, and the reasoning behind his essay follows in each of the body paragraphs, Chiat’s essay follows this deductive style. Chiat then uses this combination to capture the reader’s attention and make them want to read more with each following paragraph. Chiat pulls the reader along not only with his strong words but also by arranging his ideas in a fashion that allows for a constant pace. In the same manner, each of the points that Chiat makes relates back to the thesis. The readers are not led up to an  apparent climax only to find another exposition; Chiat’s points are clear and flow beautifully. He includes good transitions that allow the writing to have the feel of a constant flow and not have abrupt stops in the middle of the writing where a change in direction occurs. Chiat has a great understanding of how to organize his thoughts, and he demonstrates that in his writing. Besides simply writing in a way that is pleasing to the eyes, Chiat also keeps a good tone throughout the course of the writing. This allows him to keep his readers from turning to other writings. The tone throughout his essay is bitter, but Chiat remains conversational at the same time. The descriptions of the different advertisers are definitely negative; Chiat makes it clear that he does not agree with advertisers. In the concluding paragraph of his essay, Chiat challenges us to find our own personal truth rather than the apparitional truth presented to us by advertisers. In a similar manner, Chiat says in his final paragraph that people should ignore the vision of life offered by advertisers. Amidst all of this negativity, Chiat’s writing maintains a conversational feel. Chiat involves his readers directly by asking them questions, having them imagine images, etc†¦ Chiat may have held a bitter tone over the course of the essay, and though in many cases writers using a bitter tone in their writing drive away their readers with their immense negativity, Chiat does not overpower his readers with his negative thoughts and descriptions. In fact, Chiat’s calm yet bitter tone allows his readers to better embrace his feelings. Chiat uses strong word choice and rhetorical modes, clear organization, and an inviting tone to strengthen his essay on the schemes behind advertising. These different components throughout his essay enable his readers to gain a broad understanding of Chiat’s different poins and the lies surrounding them every day. Chiat uses his great understanding of these different devices to uphold a steady pace and a smooth flow. Chiat’s â€Å"Illusions are Forever† is a well spoken essay. It captures the interests of its readers, it is very informative, and it is a very relaxed read for a negative view of advertising.

Media assignment Essay The article Bad parents? Expel kids has three underlying psychological assumptions or issues. The first is that teachers are applying for new rules to allow them to expel pupils who have badly behaved parents;  Head teachersdemanded new laws to allow them to expel pupils whose parents are violent or abusive towards staff  The teachers are wanting to do this as they believe that if the parents show abusive behaviour, their children will show similar behaviour as parents are seen as role models. This links with Bandura et als Bashing Bobo study, where they showed how childrens behaviour changes to how they see adults conduct themselves. Also in the article is the view that teaching boards should be able to do everything in their powers to parents who neglect their children;  Education authorities are failing to use their powerto tackle feckless parents  Feckless parents refer to those who let their children do whatever they want to. If the parents do not make their children go to school then this will be seen as the right thing to do. This links to Skinner, a behaviourist, and his study of operant conditioning. The third psychological issue is when the general secretary of the national association of head teachers, David Hart, states; that he believes that if a parent and school has a bad relationship, then the schools should have no obligation to teach their children.  If relations between a school and a particular parenthas broken down I really dont think we should educate their children  He believes that poor relationships between schools and parents will have bad effects on the pupils education. These poor relationships link to Tajfels study on insiders and outsiders. Bandura et als experiment on Bashing bobo provides the psychological evidence behind the first issue. They created a number of situations using groups of small children, different toys a large doll (bobo) and a role model (an adult who demonstrated different behaviours). Bandura et al found that the children who were shown no violent behaviour by the model, towards bobo, showed none or little violent behaviour. However, a large proportion of the children who were shown violent behaviour towards bobo acted in a violent way also. This links to the article where teachers believe they should have the power to expel pupils whose parents are abusive towards teaching staff. This is because all parents are role models for their children. Therefore the children will see the behaviour of their parents and believe this to be the way to act. In 1938 a behaviourist called Skinner carried out a study on rats where he showed how the rats behaviour could be shaped until it learned what was required. This study supplies the psychological evidence behind the second assumption in the newspaper article. Skinner created a habitat for rats which included a lever in its cage. To start with if the rat got close to the lever food would come out of a hatch. This process progressed until the rats actually had to push the lever to receive the food. When this was learnt, the rat did not actually think consciously what it was doing, it just did it when it wanted food. This relates to the article as if these feckless parents persist in not making their children go to school then their behaviour will be shaped as they will view this behaviour to be correct. They will do this without even thinking about what they are doing or the consequences. The psychological evidence that lies behind the third issue raised is that of Tajfels study of insiders and outsiders. Tajfel carried out a study, in which there were 64 schoolboy subjects, into intergroup discrimination. He placed the boys into different groups, although the children did not know who else was in the group. He then asked them to assign money in certain ways. He found that the boys discriminated against the groups other than his own. This shows ethnocentrism, where we believe that the group we belong to is the norm and all other groups are not as good. This links to the article and the poor relations between teachers and parents. This could show that the parents believe they are better than the teachers as they are not part of their group. Therefore the teachers are discriminated against. This could go onto show that as the parents believe this so will their children, so they to will discriminate against the teachers.  In relation to the first psychological assumption I would suggest that head teachers are given the right to expel pupils whose parents are abusive towards teachers. If these changes were made then the abusive parents may think more about the consequences of their behaviour. If their attitude did change then their children would perceive this as how to act, as parents are role models. Therefore the childrens attitude would also change. This change in rules for head teachers may act as operant conditioning, which links to the study on this by Skinner. A suggestion base on the second psychological issue would be to arrange behaviour modification sessions with the feckless parents. These sessions will tell them that they need to make their children go to school as they will be rewarded in the long run. This would be because their children may get better jobs and therefore the parents will be proud and may benefit financially. The shaping of the parents behaviour will then be seen by the children and their views towards school will also change. Also the parents may encourage their children to go to school, they will do this as they will both ultimately benefit. Based on the third issue within the article I would suggest that the parents whose relationships with schools have broken down should be sent a very formal letter inviting them in for a talk. During this talk they should be shown how difficult it is to teach pupils whose parents have no respect for them. They should be told that the pupils also believe that teachers deserve no respect. How organisations can become better managers of cultural diversity on the global market Introduction The purpose of this article is to demonstrate how organisations can become better managers of cultural diversity on the global market. This paper argues that organisations can achieve success with diversity environment by finding and accepting visible and non- visible differences between values and factors in the workforce (Kandola and Fullerton, 1998). Consequently, individual organisations need to have their own theories and ideas about management and development diversity environment in the context of social-economic conditions, national legislation, culture, demography, history factors (Jones, Pringle and Shepherd, 2000; Syed 2008a). There is plenty of evidence which highlights cases of diversity management and its inputs into organisations. A significant part of the discussion in this paper is based on the framework of micro-, macro- and meso-level analysis relevant to PO Ferries as a multicultural organisation, while creating their strategy of working culture, respect and values around different level of diversity (Schneider, 2001: 27). In other words, the issue of diversity involved diverse personal characteristics, such as gender, race, culture and disability (Cox 1993; Ottaviano Peri, 2006; Thomas 1991), but also social discourses, national structures, institution and organisational processes and behaviours in the development of a multicultural workplace. This paper is structured as follows. The next section has been divided into three smaller sections in which each of them deeply explain diversity management levels based on PO Ferries examples and some of criticisms. Those sections highlight aspects and approaches which need to be taken into concern in professional management decisions if organisations want to become better in a cultural diversity market. Background Diversity management is a cultural change process (Singh, 2002) of set values and recognises the difference between people and organisations. An integrated approach to managing diversity means understanding differences which has been created by environment, adopts an opportunity, improved employee motivation (Beaver stock, 1991) and at the same time meet organisation objectives. Globalisation, migration from developing countries and a shift away from economic barriers (Hill, 2009: 3) is extremely challenging for HRM in the context of human rights laws, limitation on employment opportunities, culture influences or organisational approaches towards managing diversity. According to researches, the phenomenon of managing diversity has taken into account the framework of multilevel factors, macro-national level, micro-individual level (Syed, J. Ozbilgin, M. 2009) which can improve rules of diversity legal organisation policies and respond to a power of different circumstances in the workp lace (Johns, 2001: 39). The micro level Diversity based on individual attributes and aspirations which are part of the micro- level analysis. It is crucial to understand the individual- level factors if organisations want to achieve success and minimalism conflict and lower job satisfactions which can become the potential future problems (McMillan- Capehart, 2005). People should be treated equally regardless of race, ethic, gender, sexual, orientation or other social rewards (Jewson and Mason). For example, PO Ferries employ over 35000 employers around the world of which 34% of them are non- British and that includes 65% of men and 35% of women. Average age is 19-55 years old for man and 23- 57 years old for woman. Over 25% of non- British employees are working in highest positions like: managers, officer or team leaders (56% woman, 44% man), about 40 % are working in PO offices as call advisers and translators and the rest 35% are working as customer service stewards on boats (HRM- PO, 2009) . Previous statistics suggest that culturally diverse backgrounds do not block their career and activities because of the separation from their home country. There is a limited evidence of companies where diversity management is well- organised like PO Ferries. Organisation as a global institution need to take into concern national culture influences and design their jobs, values and multiple identities to effectively promote outcomes but also individual relationships and interaction within an organisation. Thus, Sign (2002) explain that by developing peoples opportunities to the best of their ability will be paid by commitment, innovation and creativity to organisations by employees. Managers, who manage diverse teams must adopt mix perspectives and make sure that diversity contributions are integrated into organisational objectives. Only by personal contact, face to face interactions or indirect electronic interactions, the organisation is going to build strong micro- level relationship where employees will fe el that their contributions are influenced and noticed by employers. According to PO Ferries, micro- level of analysis is representing by face to face communication between managers and employees. All ideas, problems or suggestions which involved organisation performance or sometimes even some employee private problems are discussed carefully with managers attentions and ideas to help. The literature review criticises many organisations around the world in which the opportunity for foreign woman to achieve better positions are not the same as foreign men. This can be classified as sexual discrimination which is part of micro- level diversity recruitment. UK statistics show that womens gross individual income is on average 51 per cent less then men (ECO, 2009). Employers still forget about relevant legislations and the fact that organisations need to play by the rules which cause controversial problems and criticisms. PO Equal Opportunities Policy covers all legislations which deal with discrimination (EOP, 2007). Furthermore, women who work for PO Ferries have the same respect as men and sex has no influence on the position they have. The company has 35% women working as a manager or a team leader which is 7% more and 27% in customer service which again is 12% more compared to men (PO, 2009). The macro level In management- orientation, focus should be not only on organisation benefits but also on people performances from difference of capital, labour, skills, knowledge, behaviours, communications and other cultural differences which are keys of organisations improvement and positive action (Bratton and Gold, 2004). The local phenomenon of managing diversity cannot be separate from its social- cultural, social- economic, social-political and institutional contexts (Syed and ÃÆ'-zbilgin, 2007). Professional diversity management offered by organisations needs to be universal and flexible for cultural changes. The multicultural, multilingual and multidisciplinary nature of the professional workplace has to take responsibility for cross- culture communication, corporate and dimensions. According to National Statistics (2007), Great Britain has 507,000 non- British which constitute 87% of all UK population on the end of 2007. This means that diversity is more usual than it was before and it is giving organisations opportunities to be competitive and flexible on the global market. For example PO Ferrys staff come from different countries like: Scotland (34%), Poland (20%), Spain (3%), Slovakia (9%), Italy (5%), Ireland (10%), France (15%) and other (4%). Those differences are building high performance and quality customer services compared to other subsidisers (PO, 2009). If diversity management is prepared to take organisational culture into the company environment, their success will be higher. The key point is to understand social difference codes in the workplace. Ridgeway (2006) explain social difference codes as the widely shared cultural beliefs that delineate the socially significant distinctions among people on the basis of which a society is structured and inequality is organised (p.180). In other words people can be categorized based on individual attributes and dimensions of diversity which has been mentioned as a part of micro- level but also adopted into macro- level analysis where focus is on social stratification and stereotypes as a persons status or ethnicity (Syed and ÃÆ'-zbilgin, 2007). The diversity management effort must integrate both micro- and macro- diversity awareness to make organisations effective and a friendly place for employees with different backgrounds. Management should design a polycentric strategy for managing diverse environments. There are lots of literatures which criticise the ethnocentric ways of looking on diversity. There are still many organisations where staff have not been trained to work in a diversity environment and cannot recognise the potential of cultural diversity. It is hard for them to accept the fact that changes can be good and an ethnocentric strategy will cause many problems and will not bring any improvements into the organisation. There are evidences which criticises how the host market ignored and stayed closed for changes. For example, being a foreign employee can be a disadvantage because English is not their first language (Bertone, 2004) and some employers cannot understand that foreign qualifications are as good as home ones. As a result, an immigrants education is less important as a home citizens and the possibility to find a job in their profession becomes mission impossible. PO is not allowed to discriminate anyone who has got international qualifications, because that company focuses on knowledge and training their staff to make sure that performance and high quality of service is competitive compared to other similar companies. PO is quite happy to train those people who are open for development and improvement in qualifications as long as those qualifications are relevant to job. Diversity management should in their behaviours and decisions appropriate international standards not ethnocentric mentality and go forward to improve all the time. This paper also argues that national or organisational laws, labour policies and social- economy issues can affect diverse workers. Nowadays, there are many organisations which have designed their own diversity- oriented policies. Indeed, as a result of human rights and equal opportunity laws, those policies create anti-discrimination rules in the context of micro- and macro- levels. PO in their policies clearly explain that discrimination on those levels is not allowed (EOP, 2007). Management in their responsibility must ensure that they do not engage in any form of discrimination and that they are fair with their decisions. The management strategy should not only provide rivalry (Porter, 1990) but take opportunities to embrace the high- performance based on high trust, commitment and productivity and at the same time not forgetting about employment social relationships (Godard, 2004). The meso level The last but as important as micro- and macro- level is the meso- level of analysis which highlights relationships between organisational context and component behaviour in the aspect of organisation outcomes (McCarthy, 2002: 59). In other words, social capital (Bourdieu Wacquant, 1992) is a resource which is important for a diversity managers work through organizational levels and networks between companies and employees. Most organisations expect from foreign employees to assimilate to the domestic culture. It is the management responsibility to make that happen and help a diverse workforce to achieve that access (Thomas and Ely, 1996). Being a multicultural workplace is compromised when they give employees opportunities to make their own choices based on cultural backgrounds and by not playing organisational rules. Thomas and Ely (1996) calls that approach multiculturalism. The work environment is not involved in only multiculturalism but also in the context of diversity circumstances. Bourdieu said that diversity habits like: what the worker eats, their practices, political opinions and all other individual activities are principles in the workplaces for employees. Professional organisations create friendly environments for those values, beliefs which in some points are responsible for organisational improvement and success (Syed and ÃÆ'-zbilgin, 2009). Because PO have employees from different pa rt of the world, some of the diversity habits have been taken into concern in management decisions. Food and drinks which are served for different cultured staff included French, Polish and Spanish meals. The same is with customers. The Dover- Calais route offers French and English menus. So, everyone can find something nice in the menus that the company offers. Konrad (2003) notes that it is important for managers to have focus on power relations between various identity groups in organisations and in all dissimilar individuals behaviours to avoid misunderstanding. Stone, Stone-Romero Ã…Â ukaszewski (2007) recommended that HRM processes and practices must change to be more flexible on increasing cultural diversity and HRM as a modernist project (Legge 2005: 337) should support diversity management with improvement in their decision making within the working environment. Conclusion This paper explains a framework through which diversity management can be understood from different perspectives. That framework not only brings together micro-, macro- and meso- level analysis but also helps better understand how important each of those approaches is for multicultural organisations. Both multinational businesses and multinational management need to learn how to recognize the significant of multidimensional investment in human resource development which approaches the need to develop strategy, collaborative and cross- culture competence to improve business and employees performance (ÃÆ'-zbilgin, Tatli 2008: 65). Managers need to understand that a diverse workforce can improve organizational productivity and creativity. Managing a diverse workforce is a challenge. When people from different backgrounds come together in the workplace, there is a potential for great improvement, but also a possibility for conflict. This paper has highlighted the diversity efforts on different levels and PO Ferries is an example of a company where diversity management is still developing on all micro-, macro- and meso- levels. The paper has also argued that organisations still have to change in their structures, strategy and management knowledge about diversity. Improvement and understanding is needed to become better employers, managers or leaders of diversity teams. The implications of the paper is that managers need to do more then just manage people, they have to take into account the above framework and try to do the right things (Druckers, 2001) because managing people is a challenge but also a compromise.
